Hit and Run Accidents, Uninsured Driver Accidents

One of the most common occurrence, Hit and Run accidents need quick action, as responsible parties try to escape liability. These accidents often involve pedestrians, bicycles, cars and other motor vehicles. You must report the accident to the police immediately.

If you are in a Hit & Run contact Benjamin Law immediately.  Time is of the essence as there are things you are required to do under the Insurance Act within a very short timeframe and we would want to use our resources to conduct a thorough investigation to determine if the driver or vehicle owner can be identified.

WE GET YOU IMMEDIATE HELP

Even if the identity of the driver or vehicle owner cannot be determined, we can pursue compensation for you through your own car insurance company or the Motor Accident Claims Fund if you do not have access to any insurance. These benefits may include:

  • Income Replacement Benefits – if you are unable to work
  • Non-Earner Benefits
  • Medical and Rehabilitation Benefits including chiropractic, psychological, physiotherapy services; medication; rehabilitative equipment; vocational training, home accessibility modifications and vehicle modifications
  • Attendant Care Benefits – for a home attendant and nursing care
  • Housekeeping and Home Maintenance Benefits – if you are catastrophically impaired
  • Caregiver Benefits – if you are catastrophically impaired
  • Other expenses – visitor expenses; funeral expenses; damaged items in the accident; and lost educational expenses.

LACK OF INSURANCE DOES NOT STOP US FROM GETTING YOU COMPENSATION

Under the Compulsory Automobiles Insurance Act, all vehicles in Ontario are required by law to have valid insurance. Nonetheless, there are still a number of drivers on the road driving with expired or no insurance at all. If you fall victim to an accident with a non-insured vehicle, do not be led to believe you have no recourse. Let Benjamin Law investigate if you can be compensated.

COMPENSATION IS STILL AVAILABLE TO YOU

We can also sue your insurance company under the appropriate coverage under your auto policy for:

  • Pain and suffering damages (for loss of your enjoyment of life)
  • Loss of future earnings (financial loss due to the inability to work, reduced earning capacity and loss of future opportunity)
  • Future care costs (medical care, rehabilitation and other future costs including nursing or attendant care beyond what is available from accident benefits)
  • Housekeeping and Homemaking Services
  • Compensation for family members affected by your injuries (for cost of services you provided and the loss of care, guidance and companionship they have suffered)
